In FTC and DOJ RFI, PEPC Advocates That Changing Health Care Landscape Merits Considering Additional Factors for Review in Antitrust Enforcement

The Federal Trade Commission (FTC) and Department of Justice (DOJ) released a request for information (RFI) seeking input as the two agencies work to update merger guidelines. PEPC appreciates that DOJ and FTC are taking the time to review merger guidelines. We believe that robust antitrust enforcement is necessary for promoting competition in the health care sector. Given our specific area of focus, we focused our response on how the changing health care landscape merits considering additional factors for antitrust enforcement in the health care sector.
